Fixed 5% per annum. One rate for civil and commercial money debts alike — Taiwan has no separate commercial rate and no reference-rate link, so the figure does not move with central-bank policy. Art. 203 supplies the rate whenever a debt bears interest but no rate was agreed and no other statute fixes one; Art. 233(1) applies that same statutory rate as DELAY INTEREST on overdue money obligations, with a higher contractual rate continuing to run instead. Art. 233(2): no delay interest is owed on interest itself. Art. 233(3): the creditor may additionally recover proven further loss. TRAPS: (1) Art. 205 caps AGREED interest — '約定利率,超過週年百分之十六者,超過部分之約定,無效' (an agreed rate above 16% per annum is VOID as to the excess). This 16% figure is a usury ceiling on contractual rates, not the legal rate; it was lowered from 20% by the amendment of 20 January 2021 in force 20 July 2021, which also changed the consequence from merely unenforceable to void. (2) Art. 204 lets a debtor repay early after one year's notice where the agreed rate exceeds 12% per annum. (3) Art. 207 bars compounding unless the parties agreed in writing or interest has been more than one year overdue and the debtor did not pay after demand — statutory delay interest is otherwise simple. (4) Instrument debts are different: 票據法 (Negotiable Instruments Act) Art. 97 fixes interest on a dishonoured bill at 6% per annum where no rate was agreed — do not apply the 5% Civil Code rate to bills, notes and cheques. (5) Post-judgment interest is not a separate rate in Taiwan: the court awards the Art. 203/233 rate unless a higher contractual rate applies.
