What this value means
10% per annum, in force with the Civil Code 2015 from 1 January 2017. It is a derived-by-statute figure, not a moving one: the Code sets a 20% per annum ceiling on AGREED interest (Art. 468(1)) and fixes the fallback at exactly half of it (Art. 468(2)), so the number only changes if the Code is amended — it does not track State Bank of Vietnam rates. THE CIVIL/COMMERCIAL SPLIT IS THE MAIN TRAP AND IT IS DECISIVE: this 10% applies to CIVIL money obligations. Where the dispute is a commercial one (sale of goods, supply of services between traders), Art. 306 of the Luật Thương mại 2005 governs instead and gives the aggrieved party interest on the overdue sum at the 'lãi suất nợ quá hạn trung bình trên thị trường tại thời điểm thanh toán' — the average overdue-debt interest rate on the market at the time of payment — unless the parties agreed otherwise. That is not a published figure: Supreme People's Court precedent Án lệ 09/2016/AL directs courts to establish it from the overdue lending rates of at least three commercial banks at the place of performance, and expressly rules out simply substituting the State Bank's base rate; Resolution 01/2019/NQ-HĐTP of the Council of Judges supplies the general guidance on applying interest. In practice the commercial figure typically lands well above 10%. FURTHER POINTS: Art. 468(1) yields to other laws — credit institutions lending under the Law on Credit Institutions are outside the 20% cap, so the 10% fallback does not bind bank loans. Art. 466(5) sets the separate regime for overdue loan principal (150% of the in-contract rate on the overdue portion). Interest under Art. 357 is simple and runs on the delayed amount for the period of delay only. Criminal usury (Penal Code Art. 201) is a separate threshold — five times the Art. 468 cap — and is not a civil rate.
