REFUSAL — no substantive statute gives a creditor a default interest rate outside litigation: pre-judgment interest is court discretion (Supreme Court of Judicature Act / Civil Law Act s 12), contract rates otherwise. The 5.33% per year figure is a JUDICIARY PRACTICE-DIRECTION default for default judgments and judgment debts — unchanged since April 2007, carried into the ROC 2021/PD 2021 regime from 1 April 2022, amendable by Registrar's Circular without any statute change, and the SICC may order different rates. A business cannot claim 5.33% on an unpaid invoice by statute; serving it as a late-payment rate would mislabel it. No civil/commercial split exists.
