What this value means
9% DOES DOUBLE DUTY — it is both the rate a Jordanian court applies where the parties fixed none, and an absolute ceiling: Art. 167(4) says in terms that the parties MAY NOT agree to exceed it. A contractual default rate above 9% is unenforceable to the extent of the excess. It is simple, not compounded, and one rate serves civil and commercial money claims alike, because Art. 167 sits in the Civil Procedure Law and governs what the court awards rather than any particular class of contract. WHEN IT STARTS RUNNING (Art. 167(2)): if the contract stipulates interest, the court gives effect to the stipulation; if it does not, interest runs from the date of the JUDICIAL NOTICE (الإخطار العدلي), and failing that from the date it is claimed in the statement of claim or in a later claim filed after it — so a creditor who never served notice loses the interest for the whole pre-claim period. Art. 167(1) removes any burden on the creditor to prove loss. Art. 167(3): interest also attaches to compensation and damages the court awards, running from the date the action was filed. Art. 167(5): where the defendant admits part of the sum claimed and pays that part into the court fund, no legal interest runs on that part from the date of deposit. THE SPECIAL-LAW EXCEPTION IS THE BANKS: Art. 167(4) opens with 'subject to what is provided in any special law', and the Banking Law No. 28 of 2000 with Central Bank of Jordan instructions is that special law — licensed banks price credit under the CBJ regime and are not held to the 9% figure. Do not read the exception more widely than that. TRAP — WRONG CITATION IN CIRCULATION: the ceiling is NOT in the Commerce Law No. 12 of 1966. Article 108 of that Law deals with the current account (the right to claim commissions and expenses recorded in the account), not with interest rates. Cite Art. 167 of the Civil Procedure Law. DATE NOTE: the 9% has stood since the Civil Procedure Law No. 24 of 1988, which by its Art. 1 commenced 120 days after its publication in the Official Gazette; the effective_from served here is year-anchored to that Law rather than to the exact commencement day. The 9% figure is both the default statutory rate and a mandatory ceiling: article 167(4) of the Civil Procedure Law expressly forbids agreeing a higher rate, and applies "subject to what is provided in any special law" — so sector-specific statutes (notably banking legislation supervised by the Central Bank of Jordan) can displace it. Article 167(2) governs the start date: a contractual interest clause is applied as agreed, otherwise interest runs from the date of the judicial notice (الاخطار العدلي), failing which from the date it is claimed in the statement of claim.
